Nick Diaz Planning New Year's BashCesar Gracie, the manager and trainer of former EliteXC lightweight fighter Nick Diaz, has formally filed a notice to EliteXC stating that they have breached their contract with the fighter. There is a clause in each EliteXC fighter’s contract stating that if the organization is unable to keep the fighters working, then the fighter has the right to terminate their contract. EliteXC filed for bankruptcy last week.

The clause in EliteXC’s contract, which was first reported by Loretta Hunt of Sherdog.com, states that if EliteXC is unable to fulfill the terms of its promotional and payment obligations, then fighters are allowed to terminate the contract with formal notice. In layman’s terms, once EliteXC receives notice from a fighter stating that they are prepared to work, they have 30 days to make corrections, otherwise the contract will be voided.

Gracie is already fielding calls from two Japanese organizations, DREAM and Sengoku, requesting Diaz’ services for their New Year’s Eve events.

“We’re not doing anything wrong if he fights in Japan,” Gracie told MMAWeekly.com. “As far as him fighting in the U.S., then the 30 day thing (applies).”

Dream is planning a “K-1 Dynamite! 2008” event, while Sengoku 7 will be held on January 4th. Which event Diaz will be fighting on will depend upon which promotion provides him with the best opportunity, however Gracie is confident that Diaz’s next fight will be in Japan.

“We’ll be on one of those two cards,” Gracie stated.
