Today in Clark County district court, judge Rob Bare denied an injunction request made by Nick Diaz's camp against the Nevada State Athletic Commission.MMAFighting first reported the news.
The injunction sought to negate the temporary suspension Diaz is currently on for testing positive for marijuana metabolites following his unanimous decision loss to Carlos Condit at UFC 143 on the grounds that the NSAC denied Diaz his right to due process by delaying the date of his hearing.
Diaz's case has now been added to the docket of a May 21st NSAC session. The fighter will be up against a possible one-year suspension.
The judge did urge the NSAC to set a formal precedent for the timetable by which a fighter's suspension hearing must take place to avoid any such situations in the future.
The motion for injunction was filed by Nevada attorney Ross Goodman, who represented the absent Diaz at today's court hearing.
